What Happens in Utah Chapter 13
When a debtor declares Utah Chapter 13 bankruptcy, the court does not immediately give him or her a discharge of debt. The court requires that the debtor submit a payment plan for approval. This payment plan must show how the debtor will be able to pay for his or her basic needs and still make payments on the debt. The payments that the debtor makes to his or her debts are not the normal payments but more manageable payments.
The court then gives the debtor a discharge of any remaining unsecured debt upon completion of the Utah Chapter 13 payment plan. The Utah Chapter 13 payment plan can last anywhere from 3 to 5 years depending on the specific situation and payment plan. In Utah Chapter 13 bankruptcy, the debtor is not required to give up any assets but is allowed to keep all his or her assets.
Will Utah Chapter 13 Work For Me
Utah Chapter 13 bankruptcy is not right for everyone but does help many people get back on top of their finances. One stipulation that a debtor must meet is that his or her income must be adequate for an approved payment plan. The income must be able to pay all basic needs while still having enough left over to make monthly payments on debts.
